More and more Mexican companies sell into the United States: through e-commerce, via distributors or by serving clients directly. What many discover too late is that their trademark did not travel with them.

Trademark protection is territorial

Registering your trademark in Mexico protects you in Mexico only. If your product circulates in the United States without protection there, any third party could register an identical or similar sign — and complicate your access to a market where you are already selling.

When is it worth considering U.S. registration?

Some clear signals:

  • You already sell or promote your products or services into that market.
  • You work with U.S. distributors, marketplaces or partners.
  • Your growth plan contemplates expansion in the coming years — remember: with trademarks, whoever gets there first, wins.

Routes to protect your trademark there

There are several ways to seek protection in the United States, from filing directly with the U.S. trademark office to international mechanisms that let you extend applications to multiple countries.   • Examination and objections follow their own logic and deadlines.
